The proposed claim seeks to recover damages on behalf of persons (including companies, LLPs, public bodies and charities) affected by Royal Mail’s unlawful conduct.

The definition of the persons included within the claimant class is set out below.

There are certain words used in the class definition which have a particular meaning. Those words are underlined. Click on a term that is underlined to be taken to the corresponding definition.

Class definition:

The proposed class comprises all persons who purchased or paid for Bulk Mail Retail Services (“Bulk Mail Retail Customers”) between 10 January 2014 and at least 7 June 2022.

The class includes Bulk Mail Retail Customers who paid for Bulk Mail Retail Services from Royal Mail or from an Access Operator, whether directly or via an agent.

The class includes Bulk Mail Retail Customers who paid for Royal Mail’s Bulk Mail Delivery Services separately, whether directly or via an agent.

The class excludes:

  • Access Operators;
  • Any person who opts out by notifying the Proposed Class Representative in a manner and by a time specified by the Tribunal; or
  • Any person who is not domiciled in the United Kingdom at a time specified by the Tribunal and does not, in the manner and by the time specified by the Tribunal, opt in by notifying the PCR that their claim should be included in the collective proceedings.
